Cocoa powder with sugar, chocolate spreads and other cocoa preparations outside these codes are not on the list. The minimum applies per production batch in the consignment. Smaller batches are not checked at the border, but IJHARS can still check the product later on the Polish market.

The importer notifies the regional IJHARS office (form SWW05, also online through PUESC). IJHARS checks documents, labelling and packaging and may take samples; there is no fee unless the product fails.

The whole heading 1806 is on the list for border sanitary control: the importer applies to Sanepid for a border check before customs clearance.

Milk chocolate is a composite product. Shelf-stable chocolate with processed dairy normally needs only a private attestation from the importer.

Cocoa and chocolate fall under the EU Deforestation Regulation from 30 December 2026: the first EU importer needs farm geolocation data.
Standard EU duty includes an agricultural component for sugar and milk content.
